Welcome to CLOSET! These Terms of Service ("Terms") govern your use of the website www.ofmcloset.co.za (the "Site") and any related services provided by CLOSET (collectively referred to as the "Service"). Please read these Terms carefully before accessing or using the Service.

  1. Acceptance of Terms By accessing or using the Service, you agree to be bound by these Terms and any additional terms and conditions that may apply. If you do not agree to these Terms, you may not use the Service.

  2. Use of the Service (a) Eligibility: You must be at least 18 years old or have the legal capacity to enter into a binding contract in your jurisdiction to use the Service. (b) Account Creation: In order to use certain features of the Service, you may need to create an account. By posting User Content, you represent and warrant that you have the necessary rights to do so and that your content does not violate any laws or infringe upon the rights of any third party. (b) License Grant: By posting User Content on the Service, you grant CLOSET a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such User Content in any media now known or hereafter developed.

  5. Product Information and Pricing (a) Accuracy: CLOSET strives to provide accurate and up-to-date information about the products available on the Service. However, we do not warrant the accuracy, completeness, or reliability of any product descriptions, images, prices, or other information displayed on the Service. (b) Pricing: While we make every effort to ensure accurate pricing, errors may occur. In the event of a pricing error, CLOSET reserves the right to cancel or refuse any orders placed at the incorrect price, even if the order has been confirmed and payment has been processed.

  6. Payment and Refunds (a) Payment: You agree to pay the full amount for any purchases made through the Service. Payment must be made using the available payment methods accepted by CLOSET. (b) Refunds: All purchases are final, and CLOSET does not provide refunds, except as required by applicable law or at our sole discretion.

  7. Limitation of Liability To the maximum extent permitted by law, CLOSET and its affiliates, officers, directors, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Indemnification You agree to indemnify and hold CLOSET and its affiliates, officers, directors, employees, agents, partners, and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of any third party.

  9. Termination CLOSET may, in its sole discretion, suspend or terminate your access to the Service at any time and for any reason, without prior notice or liability. Upon termination, your right to use the Service will immediately cease.

  10. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms or the Service shall be exclusively resolved in the courts of South Africa.

  11. Modifications to the Terms CLOSET reserves the right to modify or replace these Terms at any time, in its sole discretion. The most current version of the Terms will be posted on the Site. By continuing to access or use the Service after any changes to the Terms, you agree to be bound by the revised Terms.
